Derek Chauvin could serve more than a quarter of a century in prison if prosecutors get their way in his case, pending sentencing on the 25th of this month.

The former officer could serve more than a quarter century in prison if prosecutors get their way in his case.

Minnesota state prosecutors have filed papers asking the judge to sentence him for the murder of George Floyd, demanding that he get a minimum of 30 years, which they say is warranted considering the circumstances of this case.

The prosecution points out that this sentence is the highest sentence Chauvin could receive since the maximum is 40 years.

First, they argue that Chauvin abused a position of trust and authority based on what he did to Floyd, which they say created an unfair power imbalance that left Floyd defenseless.

Secondly, they say Floyd was treated especially cruelly by Chauvin. For the latter disregarded his repeated pleasure for oxygen and continue to limit him for almost 10 minutes.

Third, Chauvin committed the crime in front of several children; there were at least two minors present, making them victims as well.

The last thing prosecutors cite is the fact that Chauvin was part of a team of officers at the scene.

On the other hand the other three former police officers have not yet been tried, the State suggests that Chauvin was part of a group that allied against Floyd.

On the other hand, of course, Chauvin’s defense attorney, Eric Nelson, who would have been asked for a sentence at the lower end of the spectrum. He has suggested that Chauvin receive time and probation for the murder and manslaughter convictions.
